These Terms of Service (the "Terms") govern the provision and use of the Pitchbase Service, an online platform for AI-assisted voice sales call simulation (the "Service") accessible at https://pitchbase.app.
Any use of the Service implies the full and unconditional acceptance of these Terms by the user (the "User" or "Customer").

The User undertakes to provide accurate information and to keep it up to date. The User is solely responsible for the confidentiality of their credentials. In case of fraudulent use of their account, the User undertakes to inform Pitchbase without delay at contact@pitchbase.app.

The exact features and limits of each plan (number of simulations, call duration, access to advanced modules) are described on the Pricing page. Pitchbase reserves the right to modify these plans and prices at any time, it being understood that any modification will only apply to new subscriptions or to the next renewal for existing subscriptions.
A founder launch offer is available until May 1, 2026: prices in effect at the time of subscription are guaranteed for life for existing subscribers, even after public price increases.
Payments are handled by Stripe, a secure external provider. No banking data is stored by Pitchbase.
Paid subscriptions are charged monthly from the date of subscription, by credit card. Renewal is automatic unless canceled by the User.
In case of payment failure, Pitchbase reserves the right to suspend access to paid features until the situation is resolved. An email notification is sent beforehand.
In accordance with Article L221-28 1° of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not provided on a tangible medium where performance has begun after the consumer's prior express agreement and express waiver of their right of withdrawal.
By subscribing to a paid plan, the User expressly acknowledges that the Service is provided immediately and waives their right of withdrawal.
The User retains the right to cancel their subscription at any time (see section 8).
The User can cancel their subscription at any time from their account ("My Account" section) via the Stripe customer portal. Cancellation takes effect at the end of the current billing period. No prorated refund is granted for the period started.
Pitchbase reserves the right to suspend or terminate a User's account in case of serious breach of these Terms, including:
All elements composing the Service (interface, source code, graphic design, trademarks, editorial content, proprietary AI models) are the exclusive property of Pitchbase and protected by copyright, trademark law, and any other applicable intellectual property right.
Any reproduction, representation, modification, exploitation, or unauthorized use of all or part of the Service is strictly prohibited.
The User retains full ownership of the content they create and upload to the Service (personas, scenarios, transcripts, recordings). The User grants Pitchbase a non-exclusive, free, limited license, for the duration of the contract, solely for the purpose of providing the Service.
Pitchbase does not use this content to train its AI models nor share it with third parties (apart from technical sub-processors necessary for service delivery).
The User undertakes to use the Service in good faith, in compliance with applicable laws and these Terms. In particular, the User shall not:
Pitchbase provides the Service under a best-effort obligation. The Service relies on artificial intelligence models that, by their nature, can produce inaccurate, incomplete, or inappropriate responses. The simulations and feedback generated do not in any way constitute professional or commercial advice on which the User can rely.
Pitchbase does not guarantee that the Service will be uninterrupted or error-free. Pitchbase's liability shall not be engaged in case of:
In any event, Pitchbase's total liability, all causes combined, is limited to the total amount paid by the User for their subscription during the 12 months preceding the triggering event.
The processing of the User's personal data is governed by Pitchbase's Privacy Policy, which forms an integral part of these Terms.
Pitchbase shall not be held liable for any breach of its obligations resulting from a force majeure event as defined by French case law, including in particular: natural disasters, pandemics, armed conflicts, major cyberattacks, generalized failures of cloud providers or telecommunications networks.
Pitchbase reserves the right to modify these Terms at any time. Any substantial modification will be notified to the User by email or via an in-Service notification at least 30 days before it comes into effect. Continued use of the Service beyond this period constitutes acceptance of the new Terms.
In case of dispute, the User undertakes to contact Pitchbase at contact@pitchbase.app to seek an amicable resolution before any legal action.
Failing amicable resolution, the consumer may refer the matter free of charge to the consumer mediator to which Pitchbase is affiliated, whose contact details will be provided upon request at the address above.
The consumer may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr.
These Terms are governed by French law. Failing amicable resolution, any dispute relating to their formation, execution, or interpretation shall fall within the exclusive jurisdiction of the courts of Paris, subject to the rules of law applicable to consumers.
